Terms and Conditions for The Ink Experts
These Terms and Conditions (“Terms”) govern your use of The Ink Experts website and any services, products, or deliverables we provide (collectively, the “Services”). By accessing our website or using our Services, you agree to these Terms. If you do not agree, please do not use the website or Services.
Who We Are and What We Provide
The Ink Experts is a book writing, publishing, and creative services agency. Our Services may include (depending on your scope): writing support, editing, proofreading, formatting, publishing preparation, cover design, illustration, marketing support, audiobook production support, and website design.
All Services are provided based on the scope, timelines, and deliverables agreed in writing (email, proposal, invoice, or order form).
Eligibility and Use of the Website
You agree that:
- You will use our website and Services for lawful purposes only.
- You will not attempt to disrupt or damage the website (including through hacking, scraping, or malicious code).
- You will provide accurate information when submitting forms or placing an order.
We may suspend access to the website or Services if we believe misuse or fraud is occurring.
Quotes, Orders, and Project Scope
- Any quote or package description is an estimate of scope and deliverables.
- Your project begins after we confirm the scope and receive any required payment (as per the invoice/order form).
- Scope changes (for example, added chapters, additional illustrations, or new formats) may require revised timelines and additional charges. We will communicate changes before proceeding.
Client Responsibilities
To help projects move smoothly, you agree to:
- Provide timely inputs, approvals, and materials (manuscripts, notes, references, brand assets, etc.).
- Confirm that you own or have permission to use the content you provide (including images, text, audio, and trademarks).
- Confirm that you own or have permission to use the content you provide (including images, text, audio, and trademarks).
Delays in feedback or missing information may affect timelines.
Revisions and Approvals
Revisions, if included in your scope, are limited to the revision rounds stated in your proposal or package. Unless explicitly included, “unlimited revisions” are not offered.
A revision means edits to an approved direction within the agreed scope. A change in concept, style, or requirements after approval may be treated as a new request and billed separately.
Once you approve a final deliverable, any later changes may require a new scope.
Timelines and Delivery
We provide estimated delivery timelines based on project complexity and your responsiveness. Timelines may shift due to:
- Changes to scope
- Delayed feedback or missing materials
- Technical issues with third-party platforms
- Force majeure events (see Section 14)
We will communicate timeline updates when they occur.
Payments, Billing, and Refund Policy
- Payment terms are stated on your invoice/order form.
- Work may pause if payments are overdue.
- Fees paid for completed work are non-refundable.
If your project includes a refund policy, it will be stated in writing in your invoice/order form. If no refund policy is stated, refunds are not guaranteed and will be evaluated case-by-case based on completed milestones.
Chargebacks or payment disputes may result in immediate project suspension.
Intellectual Property and Ownership
Your content: You retain ownership of the original materials you provide to us.
Our deliverables: Upon full payment, you receive the rights to the final deliverables created specifically for your project, as defined in the scope (for example, manuscript text, cover artwork, illustrations, formatted files, website copy/design elements). Drafts, unused concepts, and internal working files may not be included unless stated.
Third-party assets: If stock images, fonts, audio, or other licensed resources are used, they remain subject to their respective licenses. We can advise on licensing, but you are responsible for adhering to license terms.
Publishing Platforms and Third-Party Services
If your project involves publishing or distribution platforms (print-on-demand, ebook storefronts, audiobook platforms, ad platforms, web hosting, etc.):
- You remain the account owner and control final settings (pricing, territories, categories, etc.).
- We can assist with file preparation and submission guidance, but platform approval is not guaranteed.
- We are not responsible for third-party outages, policy changes, account actions, or delays outside our control.
Marketing and Performance Disclaimer
If you purchase marketing-related Services:
- We do not guarantee sales, rankings, reviews, revenue, or specific results.
- Performance depends on many factors (genre, pricing, market conditions, platform policies, budget, and audience fit).
- We will provide the agreed deliverables, reporting (where available), and optimization within the scope.
Reviews, Testimonials, and Ethics
We support ethical practices. We do not sell fabricated reviews or engage in deceptive tactics that violate platform policies. Any review outreach support is intended to encourage honest reader feedback using compliant methods.
Confidentiality
We treat client materials as confidential and use them only to deliver Services. You agree not to share private project communications, internal drafts, or working files publicly without permission, except as needed to collaborate with your team.
If you require a separate NDA, we can provide one upon request.
Communications (Email/SMS)
If you provide your email or phone number, you may receive messages related to:
- Service updates, project communication, and support responses
- Scheduling, invoices, and deliverable notices
You can opt out of promotional messages at any time (where applicable) using the opt-out instructions provided in the message. Message and data rates may apply depending on your carrier.

To the maximum extent permitted by law:
- The Ink Experts will not be liable for indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claim related to the Services will not exceed the amount you paid for the specific Service giving rise to the claim.
We do not exclude liability where it cannot be excluded under applicable law.
Termination
Either party may end a project if:
- The other party materially breaches these Terms and fails to correct the issue within a reasonable time.
- Continued work becomes impractical due to non-payment or prolonged lack of client response.
If terminated, you will be billed for work completed up to the termination date, and any remaining scheduled work will stop.
